Terms & Conditions for Livestream Services

All services provided by Gopher Drones ("Provider") are subject to the following Terms & Conditions. By confirming a quote or engaging Provider's services, Client agrees to these terms.
1. Services
Provider will deliver livestreaming coverage as outlined in the service quote, including camera setup, streaming, production overlays, and optional drone footage. Service scope is fixed once agreed upon unless amended in writing.
2. Payment Terms
- 50% deposit may be required to confirm booking.
- Full payment is due within 15 days post-event unless otherwise stated.
- Late payments incur a 5% monthly late fee.
3. Cancellations & Rescheduling
- Cancellations < 72 hours before event may incur 50% charge.
- Weather/postponement reschedules are free if availability permits.
- If livestream interruption is caused by uncontrollable factors, Provider may apply a discount or reschedule at its discretion.
- No discounts are issued for Client-side delays, access issues, or interference.
4. Venue Access Coordination
Client is responsible for ensuring venue access for livestream and drone operations. This includes:
- Direct coordination with the host site
- Confirmed permissions for camera placement, drone operation zones, and power availability
Provider is responsible for all FAA licensing and regulatory requirements.
5. Intellectual Property
Unless otherwise agreed:
- All footage remains the property of Gopher Drones.
- Client is granted a non-exclusive license to use the final product for promotion and archiving.
6. Technical Limitations
Provider is not liable for disruptions due to:
- Equipment failure
- Network outages or signal interference
- Platform instability
- Weather or force majeure
In most such cases, partial credit or reschedule will be offered.
7. Drone Operations (UAS Terms)
A. FAA Compliance
All flights are conducted under FAA Part 107 by licensed, insured pilots. Provider handles all regulatory filings.
B. No Human Overflight
Important Safety Notice: Drones will never fly over any people—players, staff, or spectators. All perspectives are captured from elevated and safe-distance sideline positions.
C. Pilot-in-Command Authority
Drone operation is contingent on pilot discretion. Unsafe conditions may result in reduction or cancellation of aerial coverage.
D. Footage & Use
Drone footage falls under Section 5 (IP Ownership) unless negotiated otherwise.
E. Crowd or Safety Interruptions
If drone use is prevented due to unsafe crowd behavior or venue interference:
- No refund or discount is issued if caused by Client or affiliates.
- Partial discount may be considered if conditions were out of either party's control.
8. Limitation of Liability
Maximum liability is limited to the amount paid for the specific service. Gopher Drones is not responsible for incidental, indirect, or consequential loss (e.g. viewership, ad revenue).
9. Governing Law
These terms are governed by the laws of the State of Minnesota.
10. Agreement Binding
